OUR SITE

WHAT DO WE DO WITH YOUR INFORMATION?

On our website: When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates. 

Third party social media sites (if applicable): We collect certain information from you when you provide it to third party platforms such as Facebook Instagram & Google

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

You can request to see the data we hold for you in our store and you can ask us to erase your personal data from our records. We will redact  personal information, such as your name and address. Non-personal data, such as order information about what was sold, the date and time of the sale, and the order value is maintained.

The Elephant Box mobile message service (the "Service") is operated by Elephant Box Stainless Steel Ltd, “Elephant Box, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialling system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides updates, alerts, and information (e.g., order updates, account alerts, etc.), as well as promotions, specials, and other marketing offers (e.g., cart reminders) from Elephant Box via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Click the unsubscribe link in any text message to cancel at any time. You'll receive a one-time opt-out confirmation text message. For Service support or assistance, reply to any text from Elephant Box with HELP, or email info@elephantbox.co.uk.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. 

THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. For example, if you are buying from overseas or are making a large order we will sometimes need to pass your contact information to courier companies so they can fulfil your order. 

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and other  procedures to safeguard and secure the information we collect online. Wherever we collect sensitive information (such as credit card data), the information is encrypted and transmitted to us in a secure way. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. The computers/servers on which we store personally identifiable information are kept in a secure and monitored environment.

USER GENERATED CONTENT - UGC

Examples of User Generated Content -  Shop & product reviews (including photo & videos). Comments, photos and videos on our social media accounts. Please read and make sure you agree to the below if you are posting any content to our site or social media accounts for reviews, contests or any other reason.  

Publication of User generated Content ‘UGC’ will be at the sole discretion of Elephant Box and we are entitled to make additions or deletions to your UGC prior to publication, after publication or to refuse publication. Please note, any UGC you submit will be considered non-confidential and non-proprietary.

By submitting UCG to our website or on social media you hereby grant Elephant Box a non-exclusive, perpetual, irrevocable, transferable, royalty-free licence (including full rights to sub-license) to use, reproduce and publish your UGC (including, without limitation, the right to adapt, alter, amend or change your UGC) in any media or format (whether known now or invented in the future) without restriction. You warrant, represent and undertake to us that all UGC you submit is your own work or that you have obtained all necessary rights and permissions of the relevant owner of the work and that you have all relevant rights in your UGC to enable you to grant the rights and permissions in this clause 

Where your UGC contains images of people or names or identifies individuals, you warrant, represent and undertake to us as follows: that all featured or identified individuals that are over the age of 18 and have expressly consented to their appearance in the UGC and to you submitting the UGC to our website and where featured or identified individuals are under the age of 18, that you either: are the parent or legal guardian or such featured or identified individuals, or have obtained the express consent from a parent or legal guardian of such featured or identified individuals to their appearance in the UGC and to you submitting the UGC to our Website.

You hereby unconditionally and irrevocably waive and agree not to assert (or procure the same from any third party where applicable) any and all moral rights and any other similar rights and all right of publicity and privacy in any country in the world in connection with your UGC, to the maximum extent permissible by law. 

You warrant, represent and undertake to us that your UGC (including its use, publication and/or exploitation by us) shall not: infringe the copyrights or database rights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any other person or entity; and/or contain any material which is defamatory of any person; and/or contain misleading or deceptive statements or omissions or misrepresentation as to your identity (for example, by impersonating another person) or your affiliation with any person or entity; and/or breach any legal or fiduciary duty owed to a third party, such as a contractual duty or a duty of confidence; and/or advocate, promote, or assist discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

If your UGC contains any material that is not owned by or licensed to you and/or which is subject to third party rights, you are responsible for obtaining, prior to submission of your UGC, all releases, consents and/or licenses necessary to permit use and exploitation of your UGC by us without additional compensation.

CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
